Terms of Service

1. Scope

These Terms of Service ("Terms") govern access to and use of Windrose (the "Service"), a hosted cookieless web analytics product with an MCP server interface, operated by {{FULL_NAME}}, {{STREET_ADDRESS}} ("we", "us", "the operator"). By creating an account or using the Service, you agree to these Terms.

2. Service description

Windrose provides cookieless, first-party web analytics together with a Model Context Protocol (MCP) server that lets an AI agent query aggregated traffic data for sites you own or control. The Service is currently provided in beta, "as is" and "as available", without warranty of any kind, express or implied.

3. Account and eligibility

You must sign in with a valid GitHub account to use the dashboard. You are responsible for keeping your account credentials and any issued API keys confidential, and for all activity that occurs under your account.

4. Acceptable use

You agree not to use the Service to collect personal data beyond what the Service's own privacy design permits, to attempt to identify individual visitors, to circumvent rate limits or access controls, or to use the Service for any unlawful purpose. We may suspend or terminate accounts that violate this section.

5. Fees and billing

Billing is not yet active during the beta period; the Service is currently offered free of charge under the tiers described on the landing page (Free, Solo, Pro). We may introduce paid billing for Solo and Pro tiers in the future and will give reasonable notice before charging any fees.

6. Availability

No service level agreement (SLA) applies during the beta period. We aim to keep the Service available and reliable but do not guarantee uninterrupted operation, and we may perform maintenance that temporarily affects availability.

7. Limitation of liability

To the extent permitted by German law, our liability for damages arising from the use of the Service is limited to cases of intent and gross negligence, except for liability arising from injury to life, body, or health, or under mandatory statutory provisions such as the German Product Liability Act.

8. Term and termination

These Terms apply for as long as you maintain an account. You may stop using the Service and delete your account at any time. We may suspend or terminate an account for a material violation of these Terms, or discontinue the Service with reasonable notice.

9. Changes to these Terms

We may update these Terms from time to time, particularly as the Service moves out of beta and billing is introduced. We will post the updated Terms on this page with a new effective date; continued use of the Service after an update constitutes acceptance.

10. Governing law

These Terms are governed by the laws of Germany, excluding its conflict of law rules.
